Second Session – Day Two  Senate Impeachment Trial

There will be 24 hours of presentation by House Impeachment Managers (over 3 days); 24 hours of presentation by Defense team (over 3 days)… 16 hours of Senate questioning; 4 hours of closing arguments, equally divided; and then a Senate debate/vote on further motions to include witnesses. If there are going to be witnesses, they will first be deposed prior to testimony. No witness testimony will be permitted without first being deposed. The Senate Trial continues today with the second session at 3:50pm EST, continuing with with opening arguments by House Impeachment Managers.

by ~ U.S. Rep. scumbag/liar-Adam Schiff, D-Calif., the congressman known for falsely claiming for years he had evidence of Trump campaign 2016 collusion with Russia… and for putting a fabricated Trump phone transcript in the congressional record, has gone off the deep end this time, says talk-radio host Rush Limbaugh.  In his opening statement Wednesday in the impeachment trial of President Trump, scumbag/liar-Schiff charged that the results of elections cannot be trusted and Americans who vote are too stupid to make such decisions. “He actually said it. The son of a … actually said it,” Limbaugh told his listeners. scumbag/liar-Schiff said the Senate needs to stop an “attempt to use the powers of the presidency to cheat in an election for precisely this reason, the president’s misconduct cannot be decided at the ballot box.” Explained Limbaugh: “Meaning we can’t wait for the American people to decide because you people don’t know enough to throw the guy out. The Democrats have to be in charge of this. Your vote doesn’t count anymore.” “The president’s misconduct cannot be decided at the ballot box, for we cannot be assured that the vote will be fairly won,” scumbag/liar-Schiff claimed. The president reacted to the Senate trial from the World Economic Forum in Davos, Switzerland. “These are major sleazebags. It’s a total hoax. It’s a disgrace,” he said. The House impeachment managers contend Trump used the power of his office to pressure Ukraine to help him win the 2020 election then tried to cover up his scheme by obstructing Congress’ investigation. The White House argues Trump had a public interest in asking Ukraine President Volodymyr Zelensky to “look into” an apparent conflict of interest in Hunter Biden’s profiting from a corrupt Ukrainian firm while his father was scumbag/liar-nObama’s point man for Ukraine policy. Limbaugh said: “Folks, in a normal and sane world, scumbag/liar-Adam Schiff would have just stepped in it. … He said, ‘We cannot trust the ballot box.’ Now, where do you start with this?”… California, you need to vote this scumbag out of office,  

Impeachment, Democrats, and those 90,000 documents

Mostly they have emphasized witnesses… But on Tuesday, the first full day of the trial, the Democratic House managers seemed to turn up the call for documents, claiming that President scumbag/liar-Bill Clinton provided tens of thousands of pages of documents for his impeachment trial in 1999. “In the scumbag/liar-Clinton case, the president provided all of the documents — more than 90,000 pages of them — before the trial took place,” the managers said in a statement released Tuesday morning. “Majority Leader Mitch McConnell’s resolution rejects that basic necessity.” House Speaker liar-Nancy Pelosi backed up the managers. “For the scumbag/liar-Clinton trial, witnesses were deposed and the president provided more than 90,000 documents,” she said Tuesday. “All of the documents in the scumbag/liar-Clinton trial were turned over prior to the trial,” said lead impeachment manager Rep. scumbag/liar-Adam Schiff when arguments before the Senate began. “All 90,000 pages of them, so they could be used in the House’s case.” So a question: Where did the figure of 90,000 pages, or documents, come from? Did scumbag/liar-Clinton helpfully cooperate with the House Republicans who were trying to remove him from office 20 years ago? It turns out scumbag/liar-Schiff, liar-Pelosi, and their colleagues were not telling the whole story. They got the 90,000 figure, apparently, from scumbag/liar-Clinton’s rebuttal to the Starr report — the report independent counsel Kenneth Starr turned over to Congress on Sept. 9, 1998, after seven months of investigating the Monica Lewinsky affair. In that rebuttal, given to Congress on Sept. 11, scumbag/liar-Clinton’s lawyers wrote: “During the past four and a half years, the President has … produced more than 90,000 pages of documents and other items” to investigators. But not to Congress. The scumbag/liar-Clinton situation was entirely different from the one scumbag/liar-Schiff and his fellow Democrats face today. Starr was an independent counsel with full law enforcement powers, and his office issued many grand jury subpoenas pushing scumbag/liar-Clinton, who often resisted fiercely, to turn over the 90,000 documents over the course of four and a half years, covering the Whitewater, Travelgate, Filegate, and Lewinsky investigations. “If memory serves me correctly, I don’t think he voluntarily gave us anything,” said Sol Weisenberg, a former Starr prosecutor, in a conversation Tuesday…

Flynn Lawyers Argue For Probation Instead Of Jail Time

by CHUCK ROSS{ } ~ Michael Flynn’s lawyers argued Wednesday that he should not face jail time for making false statements to the FBI… while also accusing federal prosecutors of trying to suborn perjury from the former national security adviser in a case involving his former business partner, Bijan Rafiekian. “The government tried to manufacture facts in the Rafiekian case and they thought they could strongarm Mr. Flynn into helping them through perjury,” Flynn’s lawyers wrote in a sentencing memo filed Wednesday. “Mr. Flynn should receive a sentence, if any, of probation and community service,” they added. Flynn’s lawyers criticized prosecutors for revising their sentencing recommendation for the retired Army general. In December 2018, prosecutors recommended that Flynn receive only probation, citing his “substantial” cooperation with the special counsel, as well as in an investigation of Rafiekian on charges that he conspired to work as an unregistered agent of Turkey.  Flynn pleaded guilty Dec. 1, 2017, in the special counsel’s probe to making false statements to FBI agents Jan. 24, 2017, regarding his contacts with Russian ambassador Sergey Kislyak. He pulled out of a sentencing hearing Dec. 18, 2018, after Judge Emmet Sullivan indicated he was prepared to issue a sentence that included jail time. Flynn changed up his legal strategy in the ensuing months, hiring Sidney Powell, an ardent critic of the special counsel’s investigation. Powell accused prosecutors of withholding exculpatory information from Flynn regarding his interview with the FBI. After months of contentious legal filings, prosecutors revised their sentencing recommendation for Flynn on Jan. 7, suggesting that he receive up to six months in prison.  Powell responded to the government’s recommendation by filing a request Jan. 14 for Flynn to be allowed to withdraw from his plea deal…

Lindsey Graham, R-S.C., slammed Democrats on Wednesday for the impeachment trial, saying they are willing to destroy the country’s institutions in order to attack President Donald Trump… Graham told reporters that what he saw Tuesday was “an effort to ask the Senate to ignore every privilege that President scumbag/liar-Bill Clinton was able to exercise, Nixon was able to exercise and to suggest to the Senate that an independent judiciary really is a non-player.” Graham grew impassioned at the Senate press conference, insisting “If I was the president, I wouldn’t cooperate with these guys at all. I’m the same guy that said, you can’t fire former special counsel Robert Mueller. I encouraged him to work with Mueller. Mueller is a man of the law. Representatives scumbag/liar-Adam Schiff, scumbag liar-Jerry] Nadler, and liar-Nancy Pelosi impeached this president in 48 days.” Graham exclaimed, “I wouldn’t give them the time of day,” insisting Democrats are “on a crusade to destroy this man, and they don’t care what they destroy in the process of trying to destroy Donald Trump.” He also rejected Democratic accusations he and other GOP senators are trying to cover up what Trump did by not allowing new witnesses or evidence, emphasizing: “I’m covering up nothing. I’m exposing your hatred of this president to the point that you would destroy the institution.”

The contrast could not have been starker. One picture showed House Speaker liar-Nancy Pelosi smiling as she signed (with numerous pens) two articles of impeachment against President Trump. She passed out the pens like souvenirs to fellow Democrats. They were embossed in gold with her signature and rested on silver trays.The other picture was of President Trump signing phase one of a new trade deal with China.Which picture depicted events of greater long-term benefit to Americans? Unless you are a rank partisan out to remove President Trump from office by whatever means, the obvious answer is the China trade deal.The latest wrench thrown into the machinery of government comes from Democrats who released to their compliant media friends a “note to self” written on a hotel notepad supposedly by Lev Parnas, a former associate of Rudy Giuliani, the president’s personal attorney and a frequent flyer to Ukraine. The note said, “Get (Ukrainian president) Zalensky to announce that the Biden case will be investigated.”Democrats claim Parnas was an intermediary in the effort to get Ukraine to investigate loose lips liar-Joe Biden and his son, Hunter.Parnas’ credibility would be in doubt were he under oath before a court, instead of “testifying” on various cable TV programs. Parnas heads a company that claims to combat fraud. Oh, the irony!Democrats insist the Senate trial be “fair.” How is it fair when House Democrats continue to leak documents they hope will damage the president and influence senators to vote for his removal from office? Some Democratic senators, who will sit in judgment of the president, have already declared him guilty.It is politics at its worst and opens the door, as some of the Founders warned, for “normalizing” impeachment.Historical background is always helpful and so I consulted the National Constitution Center, a private, nonprofit organization and a leading platform for constitutional education and debate, where I found this: The “high crimes and misdemeanors” language (in the Constitution) remains controversial today. In two essays… Neil J. Kinkopf and Keith E. Whittington looked at the Founder’s vision: “The Framers meant for the phrase ‘high crimes and misdemeanors’ to signify only conduct that seriously harms the public and seriously compromises the officer’s ability to continue. If the phrase is given a less rigorous interpretation, it could allow Congress to influence and control the President and the courts…”The article continues: “When the Founders wanted to ensure accountability, they mostly relied on elections and the voters to hold government officials responsible for their actions,” said Whittington. “But what might fall into the category of ‘other high Crimes and Misdemeanors’ was still quite unclear.”Trump’s call to Ukraine’s president, which is at the heart of the impeachment articles, does not meet the standard of seriously harming the public or compromising the president’s ability to do his job as shown by the China trade deal and the USMCA trade agreement between the U.S., Mexico and Canada, both signed and passed days after impeachment.That the Government Accountability Office says the president “broke the law” by withholding $250 million in military aid to Ukraine, aid Congress had approved, doesn’t help the president’s defenders, but does it rise to the level of a “high crime and misdemeanor”? Senators will decide. But they should recall that in 2014 the GAO ruled President scumbag/liar-nObama’s prisoner deal to exchange Guantanamo Bay detainees for deserter Bowe Bergdahl violated federal law. scumbag/liar-nObama was not impeached.Speaker liar-Pelosi summed up the true motives of Democrats when she said that regardless of what the Senate does, impeachment will be a “permanent stain” on President Trump’s legacy.In fact, the stain will be on Democrats. It is Democrats who have plotted ways to reverse the will of voters who elected Trump. It is Democrats who fear he will be overwhelmingly re-elected in November.  ~The Patriot Post
