TL Davis asks why the Tea Party is not responding to the Constitutional crisis of the Roberts' Supreme Court decision on healthcare. I initially put an excerpt from the article and a link to his original article (link is at the bottom of this post). I decided to post the article in its entirety for our readers to respond here. His thoughts outline the difference between the Tea Party and the Liberty Movement. The emphasis below was added by me.
David DeGerolamo
This is the constitutional crisis the Tea Party has been waiting for. If ever there were justification for action instead of debate, the Tea Party has been handed their opportunity. If ever there were a reason to surround the Supreme Court in protest, this is it.
Silence.
Yes, they are working to solve the constitutional crisis politically, but it can't be done politically. One might repeal Obamacare all they want, it does not change the ruling that throws open the doors to government control over one's life, over their health and over their death. The ruling cannot be repealed, it must be repudiated, Chief Justice Roberts must be impeached for abuse of power and/or treason and a new court must hear the arguments all over again. (Yes, I know Obama would insert a liberal justice, does it really matter?)
Logically, none of this can be done politically; not by electing certain members of congress, or by putting in power Republicans who have allowed all of the abuses of the Obama Administration without a single cry of protest.
Republicans have allowed Barack Obama to purchase, not loan, private industry. Without a whimper, without a clamor, they have, as a body operating as a majority in the House of Representatives done nothing to hold this president accountable for his misdeeds and usurpations of Congresional power.
Electing them is going to make a difference? No, it will not. It will not turn back the hands on the clock, it will not give them backbone, it will not deter them from doing future damage to the Constitution themselves. Roberts was a product of Washington Republicans.
The Tea Party has formed itself into a political power of its own and has just as quickly proved itself to be as ineffectual and incompetent in that role as any other political power in the United States.
The Tea Party has always lacked an "if not..." counterbalance to its protestations, warnings and ultimatums. It has the power to force change, but it will not use it. It has become nothing more than a minor-league Republican support group.
Every avenue for the Constitutionalist and Patriot to demand and receive legitimate government has been denied. If not now, when? If not this, what? The crash and thunder that should have accompanied the Roberts ruling has not been heard. Those who still, despite all evidence to the contrary, think this government can somehow be righted are fools or cowards.
Right now, the Republicans in congress should be challenging everything the Obama Administration does, it should be holding investigations into abuse of power charges against every department under the direction of the administration: EPA, USDA, DHS, etc. To fail to do so is a capitulation of principles no future election or actions of the Republicans can reverse.
War has been declared upon the Constitution by those who directly benefit from its protections. Who else could do it? These are domestic enemies, there is no other definition that suffices. Is there any doubt? One might delcare that my statements are out of bounds, or too radical, but would they deny them outright? Is there one thing this government (including Republicans) have done, or not done that would support a defense for the charges I have made?
The Republicans are guilty of failing to support the Constitution by failing to invoke the power of congress to do what it clearly has the authority to do. It has the authority to not only hold Eric Holder in contempt, but to arrest and detain him to keep him from acting against the Constitution, but they will not do it, because they are afraid, they are cowards. By refusing to use the power of the Constitution they are destroying it as much as any Supreme Court ruling.
In absence of a champion, who would the Constitution look to for help? Those in power, capable and able to do it, will not. The Tea Party who has enough political capital to demand that those in power move to defend the Constitution, has not. Is it left to a ragged band of patriots? Why?
Why is it our job to move mountains and destroy ourselves in the simple pursuit of legitimate government when all of the power and all of the funds belong to those who will not do it and will not support us in our endeavors? These powerful and influential members of the conservative lobby protect themselves from bad press, but will willingly accept the fruits of our sacrifice, once dead and buried.
The Liberty Movement is being driven into a corner by both sides of the political structure: by the Democrats through open hostility toward the Constitution and by the Republicans for allowing it to go on unchallenged.
Why is it our burden? Perhaps we should rethink our objectives and our methods.

Your website is impressive and your effort is laudable! Hopefully, the COP will be an object of interest to your members, will encourage their efforts, and through its publicity will help to make it easier for them to accomplish their goals.

"Hold to account," as applied to the Supreme Court justices who have patently violated the Constitution, means impeachment by the House followed by a trial by the Senate and dismissal from office. "Hold to account," as applied to reluctant members of the House and the Senate means either expulsion by the respective house or arrest by state or local government or by citizen's arrest. Citizen's arrest is the bottom line that can be applied to government officials at any level, including federal, state, or local, who fail to do their duty to uphold the law, particularly the Supreme Law of the Land, by using their powers of arrest, expulsion, or impeachment against other government officials who are committing high crimes and misdemeanors.
Our intention is to work within the system starting as far down as necessary to get results. We may, for example, have to inform a local sheriff that he willl be subject to citizen's arrest unless he arrests the state attorney general who refuses to arrest the congressman who refuses to vote for impeachment of the Supreme Court justice who violated the oath of office to support and defend the Constitution.
As most of us are aware, the only other alternatives are revolution a la 1776 or abandonment a la Atlas Shrugged. The elections will succeed in no more than injecting a few sympathizers into the legislature and/or putting a RINO into the presidency.
A draft letter to Speaker of the House John Boehner, which will be posted on the COP website in a few days, will give an example of what "hold to account" means when the COP has 1 million members. When the COP membership grows to 10 million, "hold to account" will take on a more severe meaning. If this does not achieve results, "hold to account" will be upgraded again when the COP's support base reaches 50 million people including most of our military personnel.
We plan to take the high road, with the single objective of bringing about enforcement of the Constitution. We have no doubt that most Americans will come to support this objective.
Comment by David DeGerolamo on July 4, 2012 at 10:08am I posted Mr. Davis' article to see the reaction of the Tea Party to his analysis. I also have posted this article on Facebook and NCRenegade. What did I learn?
1. Several people attacked me for writing this article. I was called egotistical and self-promoting by Guy Smith on Facebook. My point is that a good percentage of people read the article's title, took personal offense and went on the attack without even reading it. I believe bearing false witness is covered in the ten commandments. Point 1: if we do not read, we are not learning.
2. I only post on sites that allow comments. This post engaged people to think about our future. I believe this is the first step for coordination. Point 2: If we cannot discuss opinions, problems and propose solutions, we lose. Look at Congress for an example of how we lose when personal power and politics override honor and oath.
3. Very few people understand the blow to Liberty this week by the Supreme Court decision. Point 3: We have to decide what we will do to defend the Constitution.
4. See Point 3.
What are our objectives? And how will we achieve them? I believe our objective is to give Americans our rights as given to us by natural Law. That means we need to use the same methods that our forefathers used to give us Liberty. No methods will succeed with the support of our Lord. Anyone who does not understand these simple truths is only reading the titles.

I have been working for the912project in North Carolina for several years. Their current goal is safety and preparedness and education. I was told early on by a Tea Party "official" that Tea Parties are for political change and 912ers are for God and education. After three years, I can personally say that I do not know what the Tea Party stands for. The infighting and political ideologies keep this movement from effectively organizing with a common goal.
The 2010 House victory by the Republican party is the main "victory" used by the GOP controlled portion of the Tea Party. And yet we have no budget and the deficit last year was $5 trillion. The House of Representatives controls the expenditures of funding, not the president.
I will be attending the American Liberty Congress in November. The III percent Liberty movement is small but this is the only group that has the personal conviction to actively stand up for the Constitution and the DofI. Why should we compromise on the Constitution? Even better: Why do we let the Constitution be compromised?
We currently are enslaved by debt to a federal government and although the trap is sprung, most do not realize that they are caught. When people understand their true situation, I believe public virtue will be reborn as it was in 1775. When people are retaught the concept of "public good" and "the lesser good", we can start the path to becoming a moral and virtuous people who deserve Liberty.

I looked within your website and can see that you have some great ideas for community action (once they are educated and comfortable with the direction you are guding them).
For the past 3 years, I have been involved with one form or another movements to "Challenge the Status Quo" of city, county, state & federal government.
I began Coordinating a local Tea Party effort, in my small county of 6000 people 2 years ago.
My immediate issues within this local group was "we are not going to throw mud at our city or county government....are we ??".
I started attending other meetings within a 100 mile radius from home. There, I also experienced those that exhibited "fear" with confrontation of "local government".
I joined the Tea Party Network (TPN) and began interacting with people from all over the United States and a few in "other countries that had ties here". In the beginning most seemed reluctant to share their identity and some with even sharing their opinion. But, as time has gone on, I believe that TPN has given many a "free ability to share their deepest opinions and evaluations of our current state of affairs in local and Federal Government. This is "huge step forward" in beginning an effective movment. Because, most Americans are intimidated by government and even their families (in some cases) an believe that "They must not speak their deepest thoughts lest they be criticized and ostricized". Their "Concept of Free Speech" is certainly one of being inhibited until you are in the prescence of "Friendlies".
Some of us were taught to speak your mind (even as children). Jefferson spoke with great reverence for "The Right to Speak"......not in the presence of "friendlies" (necessarily) but in the public square, church, or any other place a Citizen so desires. Freedom of Speech, Freedom of Thought, Freedom of Movement and Freedom of Production by one's Talents...certainly being Divine Gifts rather than "Man's Willingness to Allow another his Freedom.
I pray that we may return to a day, where man's freedom does not threaten the "Will of the Society in which he lives".
Semper Fidelis,
Ron

Good luck, and God bless!
Comment by Rosemarie Newton on July 4, 2012 at 8:32am David, I have also been turned off by the ineffective nature of the TP. I have an idea for getting people to get into the action, and get effective. Would you take a few minutes, go to the website, and then give me your appraisal?
Comment by David DeGerolamo on July 4, 2012 at 7:18am @Ed Stoneham
I went to the COP site and saw the following mission statement:
What does "hold to account" mean for the five supreme Court justices who violated their oath? Can the people of the United States file a suit against them? Or should my question be: Why don't we file a court case against them? What will happen when the case is denied for "the people" not having the standing authority to pursue this case?
