The National Defense Authorization Act (NDAA) was approved by the Senate on December 15th (the Bill of Rights Day). This legislation will federalize the National Guard, eliminate posse comitatus and may allow the federal government to suspend US citizens rights depending on the legal interpretation of sections 1031 and 1032.
Leading members of Congress have already indicated that they believe that these provisions [1031 and 1032] could be used by this and any future president to indefinitely detain people without charge or trial — even American citizens and others picked up within the borders of the United States.
Although most people have never heard of this legislation let alone its implications, there is another twist to the story that is not being reported. President Obama is currently in Hawaii playing his 90th game of golf today. While he is expected to increase the US debt ceiling today by $1.2 trillion (thank you John Boehner), he still has not signed off on the NDAA.
President Obama is in Hawaii playing his 90th round of golf during his term as POTUS, while on a 17-day vacation. He could have signed the bill into law before leaving, but expressed reservations and demanded changes to the Iran sanctions amendment. Several changes were added to the bill to give the administration greater flexibility. And then there is this tidbit, that shows just how irrelevant the U.S. Congress has become, at least in the eyes of one Barack Hussein Obama.
So the president is not signing the NDAA (which also sets our military funding) because he does not want to alienate Iran by instituting sanctions for their nuclear weapons program? And he wants to have complete authority over the penalties, once again bypassing Congress.
Is the current military situation in the Persian Gulf part of a "pre-planned, routine operation" or a show of force in an election year?
Iran-US brinkmanship over oil strait worsens
A showdown between Iran and the United States over Tehran's threats to close the strategic Strait of Hormuz to oil tankers worsened on Thursday with warships from each side giving weight to an increasingly bellicose exchange of words.
Iran's Revolutionary Guards rejected a warning that the US military would "not tolerate" such a closure, saying they would act decisively "to protect our vital interests."
The tough language came as two US warships entered a zone where the Iranian navy's ships and aircraft were in the middle of 10 days of war games designed as a show of military might.
But a US navy spokeswoman said later that the aircraft carrier USS John C. Stennis and the guided-missile cruiser USS Mobile Bay had transited without incident on Tuesday, in pre-planned, routine operation.
The NDAA is the latest example where we will have to read the bill after it is passed in its final form to see what is in the legislation. Our founding fathers gave so much for what we value so little.

Comment by Ranchman on January 2, 2012 at 12:31am Is it just me or does something seem really wrong here? Obama is acting like business as usual while the middle east could explode at any time...or could it? Something is definitely wrong with this whole thing, but what? Something tells me that the American people have a lot more to worry about from this administration than from Iran but what do I know.
Comment by John S Bacsenko IV on January 1, 2012 at 4:30pm This "National Defense Authorization Act" scares me NOT. There are just too many of us "gun-toting, freedom-lovin', righr-wing Christian redneck Tea Party zombies" like me out there to allow some "socialist, leftist, elitist closet marxists" to take our liberty away. Praise God and pass the ammunition!!!
Comment by Brenda Choate on January 1, 2012 at 10:31am Obama will seal the doom of free speech and this nation. NDAA was a cover for his agenda and our so called representatives allowed this to happen.
Comment by David DeGerolamo on December 31, 2011 at 6:54pm Obama has just signed off on the NDAA:

We can win with the truth if the people will stand up for our country and its principles. The majority of people have never heard of the NDAA. (You can verify this by asking people yourself as I have done). When the people stop shooting the messengers and start to listen, then they will start to be "able to handle the truth". In the meantime, we can only increase the size of the choir to which we preach.
The debt ceiling, NDAA, only 12 Congressman voting to pass a two month extension for unemployment and tax cuts, the Federal Reserve secretly bailing out European banks and the Department of Justice/DHS attacking Sheriff Joe Arpaio all happened in December. What is the response from the people?
We will win - eventually - but the people must be awakened on a larger scale than we are currently seeing.
Comment by Karen Fraker on December 31, 2011 at 10:21am James, I agree completely, Obama is so backward to what should be done. He must be getting a lot of kick backs from Iran, he also knows he can get a lot more from other countries than his own, the U.S. is cooked wiith him at the helm.

There has been an analysis of sections 1021 through 1023 that may be legally interpreted to include US citizens but fortunately I am not a lawyer. I am more concerned about the enhanced military capabilities on US soil. I am also concerned about future legislation that builds on this act. What actions or convictions lead to the loss of your citizenship? If you oppose the actions of the federal government based on new criteria which cause you to lose your citizenship, this legislation would then apply. Remember the 150,000 people put in jail by Wilson for opposing WWI?
Comment by Rich Knoch on December 31, 2011 at 8:24am The following section seems to acknowledge our 5th Amendment but we all know the devil is in the details. The president and his minions set up the procedures to implement the bill.
We also know, without a doubt, that the president is not on the side of working, taxpaying Americans, as evidenced by nearly 3 years of continuous attempts to trash our economy.
Section 1022 MILITARY CUSTODY FOR FOREIGN AL-QAEDA TERRORISTS
Part (b) APPLICABILITY TO UNITED STATES CITIZENS AND LAWFUL RESIDENT ALIENS.
Congress, the disaster it is, has a record of screwing American Taxpayers. America, Wake up before its too late!
We must excise the RINOs/Progressives/Socialists and Marxists from our government in November, 2012 or we lose our nation.
The president could restart our economy with one single Executive Order directs the regulators to stand-down and lets us develop, produce and export excess oil, gas and food. We would become the world leader in exporting in a matter of a couple of years. The world would be our market, once again. Other industry would recover and jobs would flourish once again.
One single, short paragraph has kept our economy from recovering
Comment by Debrajoe Smith-Beatty on December 31, 2011 at 8:11am Sharron there is a recall effort going on at this time. The Oath Keeper have started it. They intend to recall every congressman/woman who voted for the NDAA. Check with your local Oath keepers for information.
Comment by Sharron Deer on December 31, 2011 at 8:05am This NDAA is a mess and probably parts of it are unconstitutional. We should find out which Congressmen put in the offensive material, vote them out of office where we can, and write to them expressing our outrage.
I spent a lot of time trying to find the final bill so that everyone can read it for themselves. It's at http://www.gpo.gov/fdsys/pkg/BILLS-112hr1540enr/pdf/BILLS-112hr1540... and is really long, but this time we don't have to wait to read the final bill. The way we win is with the truth.
