The Constitutionality of Federal Gun Control Laws

  by Diane Rufino

On January 16, 2013, President Obama signed 23 Executive Orders which he claimed are aimed at reducing gun violence.  Now begins the initiative to bring his comprehensive gun control scheme to Congress. The cornerstone of the scheme will include more inclusive and…

The Proper Role of Government? They Don't Have a Clue!

What is the proper role of Government? We have witnessed the perspectives of those in government, we have heard the answers in recent presidential debates, but what did those who DESIGNED it envision? Wouldn't you like to KNOW what government is supposed to be doing? The interesting thing is, we don’t have to guess, we don’t have to make it up, we simply need to look to the framers of our Constitution. It is almost simplistically elegant the way they described the role…

Impeachment or Nullification?

This is a letter I wrote to Floyd Brown of the Western Center for Journalism in response to an e-mail I received asking me to pay to send faxes to Congress demanding Obama's impeachment.

Impeachment or Nullification?

Mr. Brown,

I read your item of October 4, 2011 calling for the impeachment of Barak Obama for a variety of either criminal or unethical conduct.  I agree that the case you…

Counter-Nullification

Nullification

is a treasured and controversial principle in United States’ constitutional

law. In our present context nullification means that states can reject or

nullify a law passed by Congress that they believe to be unconstitutional. The

most furious activity regarding nullification efforts in this country occurred

between 1820 and 1860. While many assume that nullification primarily revolved

around state’s rights and slavery, there have been movements…

Courting Disaster

Put a dress

on a guy, and he goes crazy. No, I’m not discussing a drag queen. My

observation is about judges. Before you begin sending me emails, I also have

the same view of most female jurists. My complaint is not necessarily with the

roles that judges play although I believe we have become much too litigious and

reliant on court-administered remedies for every real or imaginary affront. No,

my problem is with the Solomon-like attitudes assumed by so many…

Tennessee Legislative Update for the Week of May 10

Last week, the legislation working its way through the Tennessee General Assembly and Governor’s office took a back seat to the disastrous flooding that occurred in Nashville and Middle Tennessee. If

you would like to help your fellow Tennesseans as they work to get back on their feet, WKRN in Nashville has compiled a list of charities that are actively working to help those affected by

the…

Constitutional Ignorance from the Tennessee Attorney General

Here is a great article by Michael Boldin with the Tenth Amendment Center. He explains how Bob Cooper our

AG didn’t know what he was talking about saying the “Supremacy Clause” in the Constitution made passing the Tennessee Healthcare Freedom Act unconstitutional. I agree with Michael Boldin, the AG doesn’t know what he is talking about. Bob Cooper the AG left out part of the Constitution… Continue

Tennessee might use outside lawyer to sue over insurance mandate

Since the Tn Attorney General's opinion earlier this week that to pass the Tennessee Healthcare Freedom Act in order to block the federal legislation (Obamacare) just passed would be unconstitutional because of the "Supremacy Clause" in the Constitution. When I read his opinion I just couldn't believe a man in his position would say that, because the Supremacy clause only applies if a law… Continue

Tennessee AG Will Not Join the Other 14 States Sueing Over Obamacare-Says Challenges Are Unconstitutional

Well this just goes to show our AG doesn't know what he's talking about.

The "supremacy clause" is not valid if a federal law isn't one of their

17 enumerated powers. I can't believe a man in that position said this.

Action Item: Storm the Industrial Impact Subcommittee!

The four pieces of legislation by Rep. Susan Lynn will be up for a vote in the Industrial Impact Subcommittee of the House Commerce Committee on Wednesday, March 24 at 10:00 AM Central. This is a huge

step forward, but we have to make sure to keep up the pressure on both

Republican and Democratic members of the subcommittee to ensure that

they pass. Please be sure to be courteous, but…

Everything You Wanted To Know About Constitutional Conventions But Were Afraid To Ask...

This is a special treat today folks, a conversation between Mike Church and Dr. Kevin Gutzman about how to implement a Constitutional Convention to stop our runaway government.

Dr. Kevin Gutzman: We want to have a convention at which we would discuss revision of the Constitution.

Mike: And is this limited to any particular articles? Is it open-ended? How is it convened? How is it conducted? There are a lot of questions that people have out… Continue

WE MUST LOOK TO OUR STATES, SAYS JUDGE NAPOLITANO

Today, on the Glenn Beck show Judge Napolitano was discussing a constitutional convention, which involves 3/4 of the states to change an amendment and state nullification. I know all of the arguements against this, since people fear that we can not trust our states to do the right thing.

One of the most startling facts I heard him mention was that our founding fathers gave the government 17 powers (or specific areas that they could regulate). Today, that number has risen to 4,000… Continue
