What is the Enumerated Powers Act?

"Each Act of Congress shall contain a concise and definite statement of the constitutional authority relied upon for the enactment of each portion of that Act."

Library of Congress~Thomas A First Step Toward Constitutional Government Last October, Congress passed the Emergency Eco­nomic Stabilization Act, creating the Troubled Asset Relief Program (TARP) that has since become the executive branch's slush fund for intervening in the economy.[1] At the time, many Members of Congress believed the legislation to be unwise; only a few, how­ever, recognized that it was likely unconstitutional. That is typical for a Congress that considers itself unconstrained by the Constitution's enumeration of its limited powers. Reversing that delusion is the goal of the Enumerated Powers Act (H.R. 450, S. 1319), introduced by Representative John Shadegg (R-AZ) and Senator Tom Coburn (R-OK).

First, the Senate can impose virtually any regulation in the context of a Treaty, which makes treaty ratification a moment that requires considerable vigilance.

Second, with the dubious ratification of the Sixteenth Amendment, Congress can impose a direct tax upon the American people. This was a dangerous, unwarranted power granted in 1913 which we, at DownsizeDC.org, staunchly oppose. The results have been nothing short of disastrous. 1913 also saw the creation of the Federal Reserve, which should be abolished, as well as the ratification of the 17th Amendment, which provided for the direct election of Senators and greater democracy, with all its attendant mob rule qualities.

In other words, these three radical changes removed not only virtually all impediments on the federal government's power and ability to spend with reckless abandon, but it also created an incentive for wanton, deficit spending.

tim, august 31, 2009. a rep that makes a differnce should set the bar for the next elected rep. i believe we should have a two term limit. it keeps the voters on alert, especially for a rep that can replace the former rep.

How does HR 450 solve anything?? Those who want to pass unconstitutional laws will just refer to an unconstitutional reason; i.e. "commerce clause", or "general welfare clause" or whatever clause they decide the Supreme Court will be happy to pervert. If members of Congress will not impeach usurping Federal judges, where are the checks and balances? This resolution is a "feel good" act only. Today's congressmen would rather "obey" the supreme courts decisions than support the Constitution as they took an oath to do.

How much of this B.S. is it going to take to wake us up and realize just how close we are to exercising the ultimate right guaranteed us under the Declaration of Independence ( mandate ) and the Constitution of the United States of America. Two million people in Washington DC on 9-12 made no difference, demonstrations during the August recess made no difference, All the polls indicating the disgust and lack of confidence in Congress made no difference. the socialist communists we have put into office either through voting or no-voting them in Have decided that WE THE PEOPLE make no difference. HOW MUCH MORE WILL YOU PUT UP WITH?

If you have Democrat friends who hunt or own guns, it is vital you contact them and explain their gun rights are at risk if Sunstein is confirmed

there are some politicians that can effectively do a reasonable good job, there-fore limiting their term may not be advantageous, but a Peoples party would be the best bet, A Constitution party, or the Founders party has a nice ring.

Way to go Tom,
I feel the very same way, when are we going to do something about it.
I think the bill of rights has the answer under the second amendment.Its hard for me to understand why people elect the same failed so called representatives every election cycle. Term limits may be the answer to that question,maybe instead of worrying about re-election they can concentrate on the business at hand.There is a ground swell of anti government in the air and its starting to smell like a revolution.
