The Obamacare case was not decided today.  But the Supremes did decide the Arizona Immigration case.

 

The media wants to make this sound like it was a win for Obama.  

 

Not so fast.

The U.S. Supreme Court upheld a key part of Arizona's crackdown on illegal immigrants on Monday, rejecting the Obama administration's stance that only the U.S. government should enforce immigration laws in the United States.

 

The nation's highest court, in an opinion by Justice Anthony Kennedy, unanimously upheld the state law's most controversial aspect, requiring police officers to check the immigration status of people they stop.

 

But in a split decision, the justices also ruled that the three other challenged provisions went too far in intruding on federal law, including one that makes it a crime for illegal immigrants to work and another that requires them to carry their documents.

 

"Arizona may have understandable frustrations with the problems caused by illegal immigration ... but the state may not pursue policies that undermine federal law," Justice Kennedy wrote in a 25-page opinion.

 

Kennedy said the mandatory nature of police checks did not interfere with the federal immigration scheme, and found unpersuasive the Obama administration's argument that this portion of the law must be preempted at this stage.

 

He said it was improper to block that provision before state courts had an opportunity to review it, and without some showing that its enforcement conflicted with federal immigration law. Kennedy also left open the possibility for future constitutional or other challenges to the law once it goes into effect.

 

Arizona Gov. Jan Brewer hailed the decision as a victory for supporters of tough immigration enforcement.

 

“Today’s decision by the U.S. Supreme Court is a victory for the rule of law. It is also a victory for the 10th Amendment and all Americans who believe in the inherent right and responsibility of states to defend their citizens," Brewer said in written statement. "After more than two years of legal challenges, the heart of SB 1070 can now be implemented in accordance with the U.S. Constitution." SB 1070 is the official name of the Arizona law.

 

“While we are grateful for this legal victory, today is an opportunity to reflect on our journey and focus upon the true task ahead: the implementation and enforcement of this law in an even-handed manner that lives up to our highest ideals as American citizens. I know the State of Arizona and its law enforcement officers are up to the task. The case for SB 1070 has always been about our support for the rule of law. That means every law, including those against both illegal immigration and racial profiling. Law enforcement will be held accountable should this statute be misused in a fashion that violates an individual’s civil rights."

 

Kennedy touched on the crucial issue here but let it slide.  He ruled that Federal law preempts or trumps state law.  But in the case of immigration, what do the states do when the Federal Government will not enforce immigration laws?

 

That is the real question that was not answered.

 

The answer to the question is replacing Obama.  We can only hope that Mitt Romney really meant what he said during the primaries and he will actually secure the border.

 

Personally, I am not optimistic, but with Romney there is at least a chance something will happen.

 

As long as Obama is in power, nothing will happen.

There was no Homeland Security compliance with Federal immigration laws anyhow.

Nothing has changed. Just more sound bytes.

Simple Solution:  Catch and Hold 100 Illegals.

Randomly pick 2 from different age groups:  2 from 10 to 20 year olds; 2 from 20 to 30, 2 from 30 to 40 and so on.

Call the HS and Feds to come get them and deport them.

Track them.  If they are set free by HS  (any Fed group); hall the other 90 to the border, give them a bottle of water, and set them free - deport them Yourself Arizona and then fight HS and Feds.

If the Feds are required to and want, then the States can assume and do; or just hire a bunch of Arizona Civilians and give them the keys to the busses to the border.

Let the citizens do it.

Janet Brewer, the AZ Governor should immediately begin putting EVERY "illegal invader" of Arizona on Prison Buses and delivering them full to the District of Columbia aka Washington, D.C..

Let the Mayor of DC deal with them.

I am very glad that they have allowed the Police to ask the immigration status, but they are wrong elsewhere. The state should be allowed to do what the Fed refuses to do. Arizona has a huge prob, there are murders commited by these thugs and criminals, there are kidnappings that happen all the time due to the illegals. So it's OK that the Feds put people and mainly CHILDREN into danger by doing nothing to stop illegals but it's not OK for the Gov of a STATE...to keep HER PEOPLE safe???? Wow talk about messed UP!! Anyway, the Media will do anything to make sure that Obama looks good and if he wins re-election, they will see all of their freedoms go bye bye...it just shows that the media is really stupid lol.

So to round everything up this year Patriots here is what we have going into 2012. They tried to get rid of Scott Walker, not working for them lol :) They are trying to allow Holder to get away with Murder (Liget there) and he is losing that as well, they have tried to kill off Arizona and that didn't work either, and I have a feeling that Obama is NOT going to be happy when we hear what they have to say about the death care.....and...they think that the Tea Party is dead??????? Was listening to Rush and he mentioned that he was not surprised that JC Roberts sided with the libs--what does he know about Roberts that we don't?  Thanks for any insight and does today's ruling give you cause for concern for Thursday's decision about Obamacare?

It makes me worry that they might strike down the mandate, but leave the other filth intact, like the government having access to your bank accounts, health history, etc.

Now if only members of Congress would infer the same!

I now take time to salute Chas Jones statement about "Lawless Executive Branch".  I will chide him for not stating "dead assed Congress" full of idiots.  (Maybe not Rubio and other newbees).

Now consider what Jan Brewer stated on the 6 PM News.  She thinks Arizona Won the immigration fight.  Not so fast - the butcher job on the bill may be constitutionally correct, but it also lets the weazel in the WH loose a little more.

How to control the weazel.  One of the 6PM news comments referred to E-Verify.  Jan Brewer has her own executive priviledges in Arizona.  An Executive Order stating that to be on an Arizona Ballot (any position), the candidate must pass e-verify.  If we recall Orly Taitz fights, there is a Court Document now showing that Obozo cannot be everified - seems that he has a phoney SSAN).

Jan Brewer wins for all of us including her own Immigration Law and her own Policies.  Obama cannot be verified and would not be put on the Arizona Ballot.

It is as simple as that folks.  This was the 6 PM News. 

How does that apply to the Constitutional lead in - The Feds have declared war on the Border States and will not control immigration.  Dead Arizona citizens are casulaties of war with Foreign Drug Cartels funded with weapons from the Federals under Project Gun Runner and Fast and Furious.

We Do NOT Have a Federal, National Police Force, NOR Should we. Local, county, and State Law Enforcement officers do virtually ALL of the policing in this republic! While Local LEO's may turn over those accused of federal crimes for prosecution in federal courts ... the Federal government has almost NO resources to police and enforce federal laws.

What we have is a lawless executive branch that picks and chooses what laws it wants enforced and upon whom it wants them enforced, and that uses regulations and executive orders seeking to create laws congress either has never passed or refuses to pass, ... in short we have thuggery by a would be tyrant.

What would the federal government do if every State refused to enforce ANY federal laws?

That is a recipe for anarchy and despotism.

Scalia and Thomas were clearly the most constitutionally correct on this matter.

I say again, Gov. Brewer needs to arrest every illegal invader and have them detained and bused to Washington, D.C..

This doesn't have anything to do with Arizona, but I just received an "automatic reply" to an e-mail I sent to Lamar Alexander regarding the new MATS bill and his siding with the EPA.   I am furious!  Tennesse isn't a Red state anymore, it is more like a very pale shade of pink!!  Of course Bob Corker doesn't know which side of the fence is going to be on yet either.

Thanks very much for getting in touch with me and letting me know what’s on your mind regarding the Environmental Agency’s Maximum Achievable Control Technology regulation (also known as the ‘mercury rule’) for utilities.

 

Over the years I have learned that cleaner air means better jobs as well as better health for Tennesseans. That’s why I will vote to uphold a clean air rule that requires utilities in other states to install the same pollution controls that TVA already is installing on its coal-fired power plants.

 

TVA alone can’t clean up our air.  Tennessee is bordered by more states than any other state.  We are surrounded by our neighbors’ smokestacks.  If we want more Nissan and Volkswagen plants, we will have to stop dirty air from blowing into Tennessee.

 

Here’s why:  The first thing Nissan did when it came to Tennessee in 1980 was to apply for an air quality permit for emissions from its paint plant.  If Nashville’s air had already been too dirty to allow these emissions, Nissan would have gone to Georgia, and auto jobs wouldn’t make up one third of Tennessee’s manufacturing jobs today.

 

Every one of Tennessee’s major metropolitan areas is struggling to meet standards that govern whether industries can acquire the air quality permits to locate here.  

 

I once asked Sevierville Chamber of Commerce leaders to name their top priority.  The answer?  Clean air. East Tennesseans know that 9 million tourists come each year to see the Great Smoky Mountains—not the Great Smoggy Mountains.  They want those tourist dollars and the jobs they bring to keep coming.

 

Despite progress in air quality, the Great Smokies still is one of the most polluted national parks.  Standing on Clingman’s Dome, you should be able to see 100 miles through the natural blue haze.   Yet on a smoggy day you can see only 24 miles.

 

We have 546 Tennesseans working in coal mining according to the Energy Information Administration, and every one of those jobs is important.  There are also 1,200 Tennesseans who work at the Alstom plants in Knoxville and Chattanooga that will supply the country with pollution control equipment required by this rule. Every one of their jobs is important, too.

 

Of the top five worst U.S. cities for asthma, according to the Asthma and Allergy Foundation of America, three are in Tennessee: Memphis, Chattanooga and Knoxville.    Nashville dropped out of the top ten only last year.

 

Because of high levels of mercury, health advisories warn against eating fish caught in many of Tennessee’s rivers and streams.  Nationally, mercury causes brain damage in more than 315,000 children each year, according to the Mt. Sinai School of Medicine. Half of U.S. manmade mercury comes from coal-fired power plants.  The new rule requires removing 90 percent of this mercury.   

 

The rule also controls 186 other hazardous pollutants including arsenic, acid gases and toxic metals.  Utilities have known this was coming since 1990 because these pollutants are specifically identified in federal law.  An added benefit is that the equipment installed to control these hazardous pollutants also will capture fine particles, a major source of respiratory diseases.

 

While some have said this rule is anti-coal, I say that it is pro-coal because pollution control equipment guarantees coal a future in our clean energy mix. Long term, TVA will be able to produce at least one third of its electricity from clean coal plants.  The rest will come from even cleaner natural gas and pollution-free nuclear or hydropower.  

  

This new equipment will add a few dollars a month to residential electric bills. The Environmental Protection Agency estimates a 3 percent increase nationwide. Because TVA already has committed to install the pollution controls, its customers will pay this with or without the rule.

 

To reduce these costs, I have introduced legislation to allow six years to comply with the rule, as many utilities have requested.  I have also urged President Obama to exercise his existing authority to allow all utilities six years to comply with the rule.

 

Ever since Tennesseans elected me to the United States Senate I have worked to clean up our air, because I know that not doing so jeopardizes our health as well as our opportunity to be one of the nation’s leading states for auto jobs and tourism.
