The Federal Government is expanding rapidly. We know that.
But it is not just the spending. The Federal Government is intruding into traditional areas that are reserved for the states and we should all find this alarming.
From the Examiner:
The Department of Homeland Security is sending out its state watchdogs to arrest drunk drivers and draw their blood over Labor Day weekend.
It echoes of a national trend of the increasing presence of federal police and military troops on our streets. And the state of Tennessee is a pioneer in the ghastly movement.
In Tennessee, suspected drunk drivers will be subject to forced testing for blood alcohol levels. A new law allows police to get warrants and draw blood samples from people who appear to be driving impaired. Additionally, drivers can expect to see more sobriety checkpoints over the Labor Day weekend.
Tennessee has touted itself as the first state in the nation to have Transportation Security Administration (TSA) workers conducting random searches on its streets. Echoing DHS’s “See Something, Say Something” program, drivers are also urged to call authorities if they see something suspicious.
The no-refusal DUI check points are Constitutional. The police bring a Judge or magistrate with them, once they stop someone, if probable cause can be shown, a search warrant is signed and the 4th Amendment is complied with.
The real cause for alarm here is Federal law enforcement here. What is the Department of Homeland Security doing enforcing state laws? DUI is a state offense in Tennessee.
Tennessee has city police officers, county sheriffs and state troopers to enforce DUI laws. Tennessee does not need the Federal Government enforcing state laws.
What this is, is merging or a blurring of the lines between state and federal law enforcement. Our founding fathers feared an oppressive and overwhelming federal government and with good cause.
The federal government is already imposing its will on states through grants that come with strings. The reason we have a .08 blood alcohol limit through out the fifty states is because the federal government gave block grants to the states to enforce drunk driving laws, but the strings that came with it were that the states change their laws.
If states want to have a .08 DUI limit then it should be a decision of the states. The federal government needs to stay out of a state issue.
The Department of Homeland Security was created to fight terrorism.
Last time I checked, drunk drivers were not terrorists.
They are terrifying. This concerns me also as I see it as conditioning to accept the unacceptable. They are fighting a fight we need fought but as you pointed out they do not have authority to do so.
But Drunk drivers are not muslims so in the eyes of DHS they are home grown terrorist...
Thanks for this information. The DHS does need to be abolished. It is not serving the purpose it is suppose to.
I see the Dept. of Homeland Security and TSA specifically as real threats to every American and our basic freedoms. The States must join together to say NO to anymore federal intrusion into states rights in accordance with the 10th amendment. I have made a personal decision to not fly since the full body scanners have been put into place. I would love to travel longer distances in the future but that is out of the question as long as TSA uses these measures plus the groping of everyone not dressed in a burka.
And I heard that the males with the women in burka`s are not touched either by the TSA. But they do get everyone else in the line....
Are they arresting first or drawing blood right then and there when stopped. I find this quite suspect, and if I were a drinker and stopped, I would want a licensed medical professional drawing blood from me, but I don't drink. I don't live in Tennessee either, but I agree with you Judson, this is the Federal Government infringing on the State and its rights. Where is the County Sheriff in this instance? He is suppose to be our last defense against Federal encroachment upon citizens of a
State. He can tell the Federal agents to go pound sand and get out of his State. He has the power to do so. So, what is your Sheriff doing about this??? I would find out. The weekend is here.
Well stated. And while you are at it make sure that your State Reps understand and support the 9th and 10th amendments to the Constitution of the United States of America.
I wonder if this is this connected with some Agenda 21 type organization? If so, we haven't seen anything yet!
AND SO IT STARTS ! One state at a time! ~ 1984 ! `~ George Orwell was just off by 28 years !?!!
Actually, Orwell's timeline was fairly accurate. The depredations of Orwell's "English Socialism" against liberty and freedom by our government(s) had already begun as subtle background noise when Orwell was writing "1984" in 1948. His predictions didn't come from nothing and nowhere. They came from from what he, as an astute observer, was gleaning from events that followed the end of World War II.
Regretfully, there WILL be hell to pay in the relatively near future. At this point, I don't believe who wins Presidential elecitons will make a hill-of-beans bit of difference about that. It will not be easy and it will not be fun for anyone but it will be done. My prediction.
