Wow, the past day has been a wild ride, hasn't it? We were all prepared for a win, while steeled for a loss.
Then the Chief Justice threw a curve ball, stating ObamaCare was indeed constitutional, but only if funding is a tax!
One of the first reactions, within minutes, was a rather erudite, heavily linked, article here entitled "DID THE SCOTUS CREATE A NEW TAXING AUTHORITY NOT IN THE CURRENT CONSTITUTION?" Go here if you are interested.
Poor Judson Phillips has been hanging out at the Supreme Court for a couple of weeks in anticipation. Wasted money on an unused Football yesterday. Hope it was Chinese, so it didn't cost too much! See The football that was not spiked if you are interested.
I'll not list all the articles published here yesterday. Or the hundreds of emails I received.
Me? I said very little yesterday. I was too flabbergasted to say much.
Now, I've had a bit of time for introspection. Read bunches of articles. A good place to start is the Full text of US Supreme Court decision on health care law (193 pages)... you can find it right here. At a minimum, I'd suggest reading the Syllabus, and the Opinion of ROBERTS, C. J., (pages 50 through 65) He comes across as an irate blogger, IMHO! Attacks Ginsburg successfully, and much more. Entertaining, to say the least.
Nuclear waste(p.40) is on point too, I think.
-----------------------------------------------------------------------------------------------------------------
So, back to Roberts' options, which were either:
or,
What would the first option have precipitated?
Roberts chose the second option, allowing ObamaCare to stand for the moment. What does this do?
So, what was Chief Justice Roberts' best choice? Only history will tell us. He made his choice.
One of the highest stakes poker games ever played!
Was Roberts correct? On balance perhaps so. I hope all here agree with me!
Addendum: when you're done with this one, take a look at
Pennies from heaven...or from John Roberts? END the IRS?

What about the now unlimited power this now grants Congress to control and tax anything they want to. This decision grants Congress far too much big brother government control over our lives. They are not capeable of using the power they have now wisely what are they going to do with unlimited power to call anything a tax?
Permalink Reply by James William Olmes Rogers on June 29, 2012 at 2:15pm Yes, we all have an opinion regarding the court's decision..... And we all have a vote, come November!
Opinions don't count! Your VOTE does!
Make it count for our Constitution, wherein lies our freedom!!!
Mitt Romney vs. BHO.....
Any questions???
I like broccoli, so I'm not too worried about that new mandate, but I sure won't like being told I have to buy a Chevrolet Volt or be "taxed" $40,000.00.
Permalink Reply by Kristin Fecteau on June 29, 2012 at 2:21pm a dangerous "game" to play, while the economy continues to tank because employers will continue to hire/fire and not expand due to this decision currently standing, and while Catholics are egregiously stripped of their religious freedoms and forced to comply with a law that violates their consciences, or else close hospitals, colleges and schools in the meantime. REALLY? Roberts thought THAT was a good idea, all for a little extra assurance that the election in November might get a boost? Bull crap.
Agreed, Kristin.
A really high stakes game! If indeed it is a game....and Roberts' writings seem to bear out his true feelings in the matter.
I don't know. But more has come to the fore! Think I'll write about that as well. It's perhaps a neat monkey wrench into Socialism!
Permalink Reply by JC Patriot on June 29, 2012 at 3:12pm Did you mean to capitalize that last word? Is this revealing something sinister inside?
Ha!
Double entendre, now doubled?
Permalink Reply by Tim Sheflin on June 29, 2012 at 2:33pm Vern, I don't disagree with any of that, but, wrong is still wrong. He is the Chief justice of the Supreme Court and should be above all that political conspiracy crap. He gave his opinion political reasons, not constitituional ones. This alone makes him a pariah in my eyes.
Permalink Reply by dave williams on June 29, 2012 at 2:37pm This gives obama the right to do any thing he wants, the senate & house are non players, he doesn't need them, they got no guts anyhow.
Permalink Reply by Lee Dey on June 29, 2012 at 2:41pm To all the people who think "free" healthcare is coming, well think again. This bill gives the IRS the right to investigate our financial status to find out if we're covered by any insurance that's acceptable to the government. The IRS can confiscate our tax returns, fine us $2,100 if we don't have adequate insurance, or double that fine if we don't get the insurance in a timely fashion. In the bill, there's gun control and something about owning gold. What do those two things have to do with healthcare? John Roberts just turned our country over fully to the communists and marxists. If for some reason we don't get Obama out of the White House, be prepared to live in a third world country. The "fundamental transformation" will have been completed.
Permalink Reply by Paul Szemanczky on June 29, 2012 at 2:42pm Vern, I love you and have read you as you me for years, but I disagree. I recanted (today) in my own blog on this site as well: (yesterday's) "Is Roberts A Genius Or Absurd?" I've measured it out: he's no chess player; this was our Custer's Last Stand and he ran like Reno. We had the bullets and the ground, but he didn't have the guts. Rush almost got there today with one of his callers: a "Peter" who knew his stuff, prob. a retired judge. I wanted to yell into the radio: 55% of us are not even in the skin game; that many citizens are bought and paid for by the Obama Entitlement Plan; "Read my lips, NO new taxes!" is a meaningless phrase to them. That was 20-odd years ago; we're a dependency culture of old-hearts fading from the TP, which got a resuscitation shock yesterday, but it wasn't enought to add millions to the Tea Party, or (and I love and know him personally from Project Shining City and the tours: Lloyd Marcus) bring any minorities toour cause. Tax! tax! onion! -The Obama race doesn't believe they'll pay any fresh taxes because most of them won't; we'll pay for the 25,000,000 added Medicaid pool. The RINOs and Boehner sank this election long before this vote was cast by 9 souls. I've roasted Obama over the Hitlerian coals for almost 3 years and written 85,000 word columns to what effect? To what solace? To know that a stealth right-wing advocate of Obama rewrote the Constitution so Obama will go cont. pissing on it as his next poll brings him back up to 60%+ favor?
Yes, I see your blog Is Justice Roberts A Genius Or Absurd?, Paul!
I'll be over shortly. Many possibilities: I present just one here.
