Wow, the past day has been a wild ride, hasn't it? We were all prepared for a win, while steeled for a loss.
Then the Chief Justice threw a curve ball, stating ObamaCare was indeed constitutional, but only if funding is a tax!
One of the first reactions, within minutes, was a rather erudite, heavily linked, article here entitled "DID THE SCOTUS CREATE A NEW TAXING AUTHORITY NOT IN THE CURRENT CONSTITUTION?" Go here if you are interested.
Poor Judson Phillips has been hanging out at the Supreme Court for a couple of weeks in anticipation. Wasted money on an unused Football yesterday. Hope it was Chinese, so it didn't cost too much! See The football that was not spiked if you are interested.
I'll not list all the articles published here yesterday. Or the hundreds of emails I received.
Me? I said very little yesterday. I was too flabbergasted to say much.
Now, I've had a bit of time for introspection. Read bunches of articles. A good place to start is the Full text of US Supreme Court decision on health care law (193 pages)... you can find it right here. At a minimum, I'd suggest reading the Syllabus, and the Opinion of ROBERTS, C. J., (pages 50 through 65) He comes across as an irate blogger, IMHO! Attacks Ginsburg successfully, and much more. Entertaining, to say the least.
Nuclear waste(p.40) is on point too, I think.
-----------------------------------------------------------------------------------------------------------------
So, back to Roberts' options, which were either:
or,
What would the first option have precipitated?
Roberts chose the second option, allowing ObamaCare to stand for the moment. What does this do?
So, what was Chief Justice Roberts' best choice? Only history will tell us. He made his choice.
One of the highest stakes poker games ever played!
Was Roberts correct? On balance perhaps so. I hope all here agree with me!
Addendum: when you're done with this one, take a look at
Pennies from heaven...or from John Roberts? END the IRS?

Permalink Reply by Jeff Waller on June 29, 2012 at 8:29pm I'm beginning to wonder if Roberts was thinking on down the line, a few moves ahead, when all of those union workers start seeing higher deductions for this new tax. This thing could blow up in Obama's face like a backwoods meth lab! Let us hope that if it does, enough people wake up to the truth of it even if Obama is re-elected.

Permalink Reply by Jeff Waller on June 29, 2012 at 10:40pm THAT should be found unconstitutional, since it is a tax!
Permalink Reply by Marsha Henney on June 29, 2012 at 11:20pm Now, I have a question: Since John Boehner is saying the House will be voting ObamaCare (as a tax) down week of July 15th, what good will that do? For anything to actually happen, the Senate has to also vote. You know Prince Harry won't let it even get to the floor. So why is Boehner doing this? Is it just to make a big deal (and more publicity) on how much the Republicans don't want higher taxes on the middle class? If that's the case, I'm delighted with Boehner (and I can't often say that). Is that your take or would it be something else?

Permalink Reply by david chaney on June 29, 2012 at 8:52pm Romney needs the individual mandate for Romneycare. Roberts is a Washington Insider. This was quite predictable. If fact I predicted it in post awhile back. Romney will make some improvements, but the fundamentals will stay the same. If you want the individual mandate and tax penalty dispensed with, the voters will have to bring the pressure to bear on Washington. Roberts and Romney come with the Washington Elite seal of approval and they want a Healthcare Plan. I'll have to bookmark this so I can say I told you so. Romney will find a way to blame the democrats. Perhaps the Washington Elite along with the media will see to it the democrats control the Senate or Congress. They just have to keep things close and then do something to push the election one way or the other.

We were lied too and told it was a mandate, tHE POTUS was on the TV repeating the lie over and over that it is NOT a tax.
There is a difference between the two -- implemention and truth.

You are right ! We keep "digging in every pile of pony poop that the President, Congress and Court drop...looking for a pony".....These are a bunch of lying, deceitful bastards that have nothing but their interests involved in their decisions !
We need to understand that "We The People" have no damn representation in Washington, D.C. ! Further, until such time as we replace every damn one.....we will have rotten and useless decisions from them all !

Permalink Reply by Marsha Henney on June 29, 2012 at 10:27pm Mark Levin certainly doesn't agree with you. Nor does Ted Cruz, also a constitutional attorney, running for Kay Bailey Hutchison's seat in Texas. Hearing their reasoning, I will go with them. Roberts is no hero and in fact has removed a significant level of trust. Nowhere to go, now is there?
In addition, I resented his pithy statement that the court is not responsible for the consequences of our votes. Well, the court is responsible for correct interpretation of the Constitution and not the rewriting of a law to fit the Constitution. WE can - and will - correct our error in November. Unfortunately, WE will live with - and be threatened by - John Roberts' error forever.
