Wow, the past day has been a wild ride, hasn't it? We were all prepared for a win, while steeled for a loss.
Then the Chief Justice threw a curve ball, stating ObamaCare was indeed constitutional, but only if funding is a tax!
One of the first reactions, within minutes, was a rather erudite, heavily linked, article here entitled "DID THE SCOTUS CREATE A NEW TAXING AUTHORITY NOT IN THE CURRENT CONSTITUTION?" Go here if you are interested.
Poor Judson Phillips has been hanging out at the Supreme Court for a couple of weeks in anticipation. Wasted money on an unused Football yesterday. Hope it was Chinese, so it didn't cost too much! See The football that was not spiked if you are interested.
I'll not list all the articles published here yesterday. Or the hundreds of emails I received.
Me? I said very little yesterday. I was too flabbergasted to say much.
Now, I've had a bit of time for introspection. Read bunches of articles. A good place to start is the Full text of US Supreme Court decision on health care law (193 pages)... you can find it right here. At a minimum, I'd suggest reading the Syllabus, and the Opinion of ROBERTS, C. J., (pages 50 through 65) He comes across as an irate blogger, IMHO! Attacks Ginsburg successfully, and much more. Entertaining, to say the least.
Nuclear waste(p.40) is on point too, I think.
So, back to Roberts' options, which were either:
What would the first option have precipitated?
Roberts chose the second option, allowing ObamaCare to stand for the moment. What does this do?
So, what was Chief Justice Roberts' best choice? Only history will tell us. He made his choice.
One of the highest stakes poker games ever played!
Was Roberts correct? On balance perhaps so. I hope all here agree with me!
Addendum: when you're done with this one, take a look at
I did forget that Scott. It wasn't even voted in properly from the beginning. It was forced upon us!
Yeah, that's kinda what tyrants do.
If it goes the way it was hopefully planned by Chief Justice Roberts, then it was a stroke of genius! The liberal scumbags will now have to backpeddle all of their "victory" dancing to explain how a new tax will be added just for non-'compliance (thus making the penalty payers the ones financing this thing) with the socialist healthcare plan! THIS should be interesting to watch in the final days leading up to the election! Now, if we can just stop the dead and illegal voters from electing the commie Obommie, we should be all set in November!
I'm noy actually agreeing with what happened! It is more of a "what if???....." I really don't like to see the Constitution trampled, either!
However, there is a small problem. Only the initial "benefits" of ObamaCare will be seen before the elections. None of the actual taxes on the masses until 2014. The hidden taxes to the businesses begin in 2013 when the 6,000 new IRS workers report to duty. Soooo, all the Obamaites will see is the Republicans taking away FREE (or so they think) services including birth control, which is due to become effective August 1st (about 5 weeks).
It's imperative now that Romney focus both on employment and the taxation in a big way. The second is going to be hard convincing a lot of people. As for team Obama, lying has always been the specialty and Axlerod, et al, are going to work overtime convincing their minions that there are no taxes.
I totally disagree with you. I would love a "right wing conspiracy" that upheld the Constitution and ended Obamacare. When Obama was inaugurated, Rahm Emanuel literally thumbed his nose at George Bush during the swearing in ceremony. I want to thumb my nose at every northeastern liberal. What we now have is a double or nothing crapshoot. I don't like to gamble with my Constitutional rights, but I now have to. We have to run the table this November winning the Senate, the Presidency and the House.
Now that all the shock is settling in, lets discuss what happened to John Roberts to make him sell his soul to the devil. A few weeks back, I saw an article that the democrats wanted to "work on" one of the conservatives to make them change their mind and side with them. The Obama administration must have declared Roberts was the weak link (wimp). Then Roberts' presence was requested at the White House. Does anyone see where this is going?
Then yesterday Roberts did an about face. Did Roberts' visit to the White House have anything to do with his decision?
Did Obama give Roberts an "offer that he couldn't refuse"? You know what I mean...................it's that old Chicago thug politics rearing its ugly head again.
Holy cow! I had forgotten about that! The plot thickens...........
"....sell his soul to the devil"?
I don't know, of course. But I find twice as many positives to this approach, than were he to align with the right!
Just flipping the rock over to see what's on the other side. History may find Roberts to have been among the greatest of patriots! It's interesting, I find.
Lee, could you find the link to that article? Why would he be summoned to the White House? I don't think there should have been any communication between a judge preparing to rule on a case with someone intimately involved with the case. Is that appropriate?
Nope, not appropriate. But very effective depending on what threats ... I mean, promises were made.
I have googled it and can't find anything - but I distinctly remember it having happened.
