Sometime tonight, Humberto Leal may be put to death by the State of Texas. If Texas executes him, it will be over the objections of the Obama regime and those who seek to give illegals more rights than American citizens have.
The facts are really not in dispute. Humberto Leal came to America, illegally, when he was two years old and remained here. In 1994, he brutally raped and murdered an America girl, 16-year-old Adria Sauceda. The violence of this crime was horrifying. Leal was captured and confessed to the crime. He was read his rights. You know, you have the right to remain silent, etc. He waived his rights and spoke.
The problem for some people is that there is one right Leal has that he was never told about. The Vienna Convention is a treaty that says if someone is arrested in another country, they have the right to immediate assistance from their embassy.
Just so we are clear on the facts. Leal entered the country illegally (granted he was two years old at the time), stayed in America all the rest of the time until he murdered and raped an American, yet he was supposed to get immediate help from the Mexican embassy.
Mexico, which believes its citizens have the absolute right to come to America, commit any crime they want and not be punished for committing those crimes, is complaining about the execution.
The Obama Regime, always more concerned about the rights of anyone but Americans has joined the fray, demanding that Texas call off the execution and that the Supreme Court intervene.
One of the claims the Obama regime makes is that if we do not stop this execution, other countries might not honor the Vienna Convention for American citizens. As with most liberal claims, they do not stand up to the facts, or to quote John Adams, “facts are stubborn things.”
In 2008, Texas executed Jose Medellin. He was a Mexican national who committed capital murder in Texas and he raised the same claim. The Bush administration, ever diligent to make sure they appeased Mexico, supported this and allowed the International Court of Justice to enter an order telling Texas to conduct new hearings and possibly new trials for 50 Mexican nationals on death row because of their claims they were not informed of their rights to talk to their embassy.
Texas told Bush and the International Court where they could go and how they could get there. The United States Supreme Court backed Texas and Medellin got his just reward. Amazingly, since 2008, there has not been a wave of American being arrested in foreign countries and being denied access to diplomatic personnel. The only exception to that being the arrest of Terry Jones in Detroit.
Liberals have made their latest push, arguing for a delay so congress can make new laws that restrict the death penalty if a foreign national is not given access to their diplomats. However, congress has had three years to pass this bill and has done nothing with it so far.
The left looks for any excuse to avoid the application of the death penalty; despite the fact most Americans believe the death penalty is appropriate in many cases. The left feels like real Americans are barbaric and we should feel sympathy for this rapist/murderer.
Fortunately, Texas does not care what liberals think.
UPDATE: The US Supreme Court is not going to block the execution.

Permalink Reply by Rob on July 10, 2011 at 12:07pm I know I am late to this party but just my 2 cents.
I read what he and others did to that 16 year old girl at the party she was at and I feel he should have been passed around to the blacks in prison who have not seen a women in about 6 years. Then only then after he was passed around should he have been killed but not in the way he was.
They should have taken wet leather after he was tied to a tree facing east put one around his forehead one around his neck and the last around his boys downstairs. Then put a mirror in-front of him so he could watch as the life went out of his eyes, as the sun came up. That would have been the proper death for this animal. It would also teach other illegals that we will stoop to different levels depending on the crime they commit.
