On Tea Party Nation, we have told you of the ongoing saga of Juana Villegas, an illegal alien, who was arrested in Nashville while she was nine months pregnant.  While in custody for minor criminal charges and an immigration warrant because she had been previously deported yet returned, she gave birth to a child.  She was shackled during most of the labor because she was in the custody of the Davidson County Tennessee Jail!   She turned around and sued the Sheriff of Davidson County for doing his job.  Now, this story has taken a more even outrageous turn.

 

Villegas has applied for what is called a “U visa.”

 

What is a U visa?

 

It is a visa for illegal aliens who are “victims” of crime.   What is the crime Villegas is the victim of?  You guessed it.  Being arrested for being in this country illegally and having the Davidson County Sheriff’s Department follow procedure which requires inmates taken in for medical procedures be shackled or otherwise restrained. 

 

This is truly a world turned upside down as her attorney, who has a far left open borders advocate, wants not only to have her granted legal status in this country but wants a criminal investigation that could result in American citizens who are members of law enforcement not only losing their jobs but potentially being charged with criminal offenses.  A criminal charge brings the possibility they could be convicted and even sentenced to prison. 

 

That is right.  You have an illegal alien, who has been previously deported from this country, who is now trying to get a visa, claiming she is the victim of a crime, because law enforcement did the job they were required to do.

 

Villegas has already had her deportation deferred indefinitely.  What that means in plain, non-lawyer English, she will not be kicked out of the country and she is now eligible for a work permit!

 

The deferral is at a temporary measure, which can be revoked at will if something happened, say like we got a real American President in the White House who would enforce our laws.

 

The U visa was created in 2000 as a tool to “encourage” illegal aliens to come forward and report crimes.  They were not used much until 2009.  Suddenly, when the Obama regime came in, this tool became very popular.  Last year, 20,000 of these visas were issued last year.

 

Of course, the Obama regime does not want any illegal deported because illegals can be a huge poll of illegal voters. 

 

Villegas was awarded $200,000 in a recent law suit against the Davidson County Sheriff’s Department.  The Federal Judge in that case, a left wing Clinton appointee, took the issue of liability away from the jury and ruled for the illegal alien.  Villegas had demanded over a million dollars in damages. 

 

Fortunately, the case is on appeal to the 6th Circuit.

 

When we get conservative control of government again, we need to enforce our laws.  The border needs to be sealed and our immigration laws need to be followed.  We also need to start changing some laws.  The “U visa” needs to be abolished and we to change the law so that someone who is in the country illegally cannot sue. 

 

America needs to stand up to these outrages.  It is bad enough that an illegal alien is allowed to sue for being arrested, but the idea that law enforcement could be subject to a criminal investigation and possible prosecution for following the law is too much.

 

This is just another reason why the party of treason must be voted out.

That sucks!

     I think human rights are a given, and they cross national borders. If I was pregnant in another country, I wouldn't want to be shackled and treated inhumanely while giving birth. This has nothing to do with political party or illegal immigration. Civil Rights and human dignity transcend political parties. These rights are guaranteed by our constitution, not so that we can in turn treat foreigners and aliens like dogs, but so that we can enjoy like all men, the rights to life, liberty, and the pursuit of happiness.

     The problem is in our borders being vulnerable. If we can't secure our own borders, we have a real national security problem that goes beyond the perceived "criminal act" of individual survival and illegal immigration attempts.

In Iran under the Shah, if an abulance was called for a non-muslim woman in labor, it would put her on board and drive around town until she delivered the baby - unassisted - or died. This had nothing to do with the Shah, it has to do with the Muslim religion; i.e. Infidels are unclean.

What Americans fail to realize is that once you leave this country you have no rights.

Many countries, to include South American and many Middle Eastern countries reserve all rights for their CITIZENS.

If you are traveling abroad as an ordinary American citizen and find yourself in a bad situation, do not waste your time trying to reach the American embassy. Go to the Canadians or the Australians first and then the English and the Russians.  As an American citizen I could not get into the American Embassy in Tehran until I managed to get in contact with someone that I knew on the inside, even though I was there on official business. The British and Scandinavians that I was to do business with did not have the same problem.

In Bangkok Thailand, a friend and I were escorted out of the American Embassy because my friend who is a retired Naval Officer was trying to cash a check in the exchange. One of the Marines who put us on the street told us if we needed help to get home we should go directly across the street to the Russian Embassy.

Thank God for the U.S. Marines!

This is exactly what you get when city council is made up of liberals.  Austin CC just handed a family nearly a million dollars because a cop was doing his job.  Unfortunately it ended with an 18 year old kid being killed.  Now why didn't the parents do THEIR job when their son pistil whipped someone when robbing them, or when he was robbing ATM machines, or when he was doing his drugs.  Also awarded was the guy who was with this "model citizen" because he was shot when lunging for the officer.  He got just under $200,000.  The cop was Hispanic, plus the police were called by the neighbors because they were concerned they were going to get shot since he was shooting, himself.

 

What is even more outrages is this issue was put to rest about a year ago, the cop was punished for "not following all the guidelines", but a council member decided to put it back up on the table for vote.

We also don't know the extent of how she was treated.  Tho probably not the ideal position but one can give birth with their ankles together.  If they would have tied her thighs together like the Nazi's did to the pregnant Jews when it came time to deliver that would be horrible!!!

Under the clean hands doctrine, a person who has acted wrongly, either morally or legally - that is, who has 'unclean hands' - will not be helped by a court when complaining about the actions of someone else.

The woman had unclean hands, because she had broken the law in the first place by coming here illegally.

There's another way to look at this situation.  America should be an open haven to immigrants just like she was in the early part of the 20th century.  We should NOT close our doors to earnest, honest people who want to work and build a life so long as there are no communicable diseases and they have some money to support themselves.  But to just shut the doors to honest people is NOT American.  New people bring new blood and new ideas to this nation.  How many Carnegies, Kelloggs, and Barishnikovs have we turned away? Tens?  Hundreds? Thousands?  Who knows.  We are the land of the free and the brave...and if you're brave enough to come here and start over again and build a life for your family then your good enough to breath the air of Freedom in America.

True! We need to take a long hard look at Emma Lazarus' words on the base of the Statue of Liberty before we send away and/ or chain and abuse these "huddled masses yearning to breathe free."

 I agree. This whole affair is outrageous. Was the baby harmed? I haven't heard anything about  that, so I suspect the child is all right.She is an illegal, and she returned after being deported. That indicates that she intended to risk being arrested. I recommend removing the money she was awarded, and drop her back where she came from. No punishment for those who arrested her as they we doing their job, legally. Good Lord, how we have been corrupted by the Kenyan usurper. I am praying for Obama to be a not even one whole term president.

I agree.  At what point do we AS American's get to say enough is enough and quite taking advantage of who we are?  My grandparents came from Poland... legally!  They came with nothing and was given nothing!  They had to work for every morsel of food they put on their table to feed their children, no special favors.  My mom started school knowing only Polish but she made sure she learned the language well.  She wanted to quit school in HS thinking she could work and support the family but her dad would have nothing to do with it.  He demanded she be educated so she wouldn't have to spend her life flipping hamburgers, or be so stupid that she had to depend on others for her welfare while being taken advantage of.  THIS is the kind of immigrant we welcomed then and welcome today, not someone who comes and drains all of the good we have out of us.

(I've already contributed a few times to this one and part 1). I signed up for the day of rage, but haven't gotten through screening, yet.

But I read these posts and cannot resist commenting.

Being the son of immigrants who got here legally and had to struggle their whole lives to achieve a lower middle class status, this is the way 'our' system is designed, and the only way it works.

I grew up in a neighborhood that had all nationalities, mostly immigrants, for most (like my mother) English was a second language. Some achieved more financial success than others. If you messed up you got locked up, not rewarded. My parents managed to buy a house and then saw it lose most of its value and the neighborhood nose dive when HUD bought out the surrounding neighborhood and built projects.

I saw the unfortunates whose lifestyle was to have babies and collect welfare. It was decades ago when the illegals were South and Central Americans and Puerto Ricans working landscaping, construction, agriculture, kitchens etc. Everyone knew... you had to know or you were blind. But apparently it was benefiting someone so it was overlooked

It wasn't benefiting me.

So now we have illegals and those addicted to entitlements on the verge of bankrupting us financially and morally.

Allowing these breaches breeds disrespect for the law and cripples the spirit of those trying to make it legitimately. I think illegals are brazen not brave. Using a baby as a shield from deportation and to manipulate the emotions of well intentioned but naive individuals is not something to encourage. And on and on. We get hammered every day by another outrage.
