
On Tea Party Nation, we have told you of the ongoing saga of Juana Villegas, an illegal alien, who was arrested in Nashville while she was nine months pregnant. While in custody for minor criminal charges and an immigration warrant because she had been previously deported yet returned, she gave birth to a child. She was shackled during most of the labor because she was in the custody of the Davidson County Tennessee Jail! She turned around and sued the Sheriff of Davidson County for doing his job. Now, this story has taken a more even outrageous turn.
Villegas has applied for what is called a “U visa.”
What is a U visa?
It is a visa for illegal aliens who are “victims” of crime. What is the crime Villegas is the victim of? You guessed it. Being arrested for being in this country illegally and having the Davidson County Sheriff’s Department follow procedure which requires inmates taken in for medical procedures be shackled or otherwise restrained.
This is truly a world turned upside down as her attorney, who has a far left open borders advocate, wants not only to have her granted legal status in this country but wants a criminal investigation that could result in American citizens who are members of law enforcement not only losing their jobs but potentially being charged with criminal offenses. A criminal charge brings the possibility they could be convicted and even sentenced to prison.
That is right. You have an illegal alien, who has been previously deported from this country, who is now trying to get a visa, claiming she is the victim of a crime, because law enforcement did the job they were required to do.
Villegas has already had her deportation deferred indefinitely. What that means in plain, non-lawyer English, she will not be kicked out of the country and she is now eligible for a work permit!
The deferral is at a temporary measure, which can be revoked at will if something happened, say like we got a real American President in the White House who would enforce our laws.
The U visa was created in 2000 as a tool to “encourage” illegal aliens to come forward and report crimes. They were not used much until 2009. Suddenly, when the Obama regime came in, this tool became very popular. Last year, 20,000 of these visas were issued last year.
Of course, the Obama regime does not want any illegal deported because illegals can be a huge poll of illegal voters.
Villegas was awarded $200,000 in a recent law suit against the Davidson County Sheriff’s Department. The Federal Judge in that case, a left wing Clinton appointee, took the issue of liability away from the jury and ruled for the illegal alien. Villegas had demanded over a million dollars in damages.
Fortunately, the case is on appeal to the 6th Circuit.
When we get conservative control of government again, we need to enforce our laws. The border needs to be sealed and our immigration laws need to be followed. We also need to start changing some laws. The “U visa” needs to be abolished and we to change the law so that someone who is in the country illegally cannot sue.
America needs to stand up to these outrages. It is bad enough that an illegal alien is allowed to sue for being arrested, but the idea that law enforcement could be subject to a criminal investigation and possible prosecution for following the law is too much.
This is just another reason why the party of treason must be voted out.

If what is ostensibly a human right is somehow deprived to someone then that someone gets $200K and gets to stay?

Their rulings and actions should and must follow the law, whether they agree with the laws or not. The question of equal justice under the law requires that those in the position of ensuring same, do so within the moral and ethical standards upon which the laws were written. To go beyond or outside of these standards and expectations - undermines their intent as well as the administration of justice which should always remain impartial and unbiased. When a Judge relieves a jury of its responsibility and strikes down its verdict, then that Judge calls into question his/her ability to remain impartial. The Judge is not the determiner of justice in a jury situation, unless the jury decision is so eggregious that it is blatantly outside the law itself. Then and only then should a Judge intervene, but only to the extent that his ruling would require a "fresh" look at the evidence by a new jury....or by a different court of competent jurisdiction.
It is readily accepted that common sense is to be exercised within the boundaries of Common Law. To do otherwise ensures that "favortism" is being granted and the pre-emption of established law, its process and procedures are being abandoned for the sake of personal ideology. The founders never intended that the laws were to be warm and fuzzy, but rather that they should be wisely and fairly applied.
