Imagine 200,000 people.  Even the largest football stadium in American could not hold that population.   That is about the same size as the population of Richmond, Virginia.

 

If something or someone killed 200,000 Americans a year, do you think that there would be outrage?  Do you think there would be calls to punish those responsible?  Do you think there would be some type of effort to control this?

 

What kills 200,000 people in America every year and is totally ignored by the America people?

 

In 2010, approximately 14,748 people were murdered in the United States.  In 2010, drunk drivers killed 10,288 people.

 

So what kills that many people?

Preventable medical mistakes and infections.  According to Scientific American, in 2009, found that 200,000 people a year died from preventable medical mistakes and preventable infections.  If it is preventable and it happened, that means someone screwed up. 

 

Ten years earlier another study determined that between 44,000 and 98,000 people were dying every year due to medical errors.

 

Why is this important to America?

 

Because there is a concerted attack on our Constitution. 

 

That attack is Federal Tort Reform.

 

It is every bit as unconstitutional as Obamacare.  For anyone who wants Tort Reform, please show me where the Constitution allows the Federal Government to impose these type laws on states, where these powers have always been reserved to the states since 1787.

 

The big myth that those who support Tort Reform always throw out is the myth of the frivolous lawsuit.  Of course, for Doctors, any lawsuit filed against them is frivolous. 

 

If you go to prisons and ask inmates, everyone one of them is innocent too.

 

In 2006, the National Academy of Sciences reported medication errors injured 1.5 million people in the United States each year!

 

In 2004, Medical News Today reported there were 1.14 million “patient safety incidents” in one year.  Patient safety incident is a nice way of saying that a Doctor, a nurse or a hospital screwed up.

 

The civil justice system is a wonderful part of the free market system.  Remember what the free market system does.   It punishes bad behavior and rewards good behavior. 

 

Civil law suits against doctors punish bad doctors. 

 

The problem we have is that there are a lot of mistakes being made out there.  The medical lobby does not want to talk about that.  All they want to do is scream about the myth of the frivolous lawsuit, while saying nothing about the estimated 200,000 Americans who die each year from preventable medical errors or preventable infections. 

 

I have never understood why conservatives are so anxious to follow the lead of the Doctor’s lobby and the big insurance lobby, who were two of the biggest drive forces for Obamacare.

 

The civil justice system is a part of our free market.  Our free market system is one of the guarantors that we have a free nation. 

 

If you are injured, do you want a government bureaucrat to decide what your injuries are worth, or worse, a member of Congress? Or would you want twelve of your fellow citizens deciding the justice you should receive?

 

I don’t know about you but I have my faith in the goodness of 12 citizens chosen to serve.

Government has no business in the health care field.

Interesting point.  I think my objection was the size of the awards.  Is it really a "free market" when a single guy, the judge, determines the award, and a fellow lawyer gets, not a flat, predetermined fee, but a percentage of the award?

On the other hand, I know of an instance where ER doctors fired a guy in their group for molesting female patients and yet gave him a favorable review when he applied at a hospital in another state.  Eventually he raped an elderly patient.  As far as I know, he's still in prison.  The docs who fired him knew he was bad, but failed to blow the whistle on him.  Ditto an anesthesiologist who left a trail of bodies behind him (same hospital as the ER docs) because he was incompetent.  Physicians don't seem to do a good job of policing their own.

The Second American Revolution is on it's way.  This is how this will be repaired.  The Original Constitution of the United States of America will be re-instated.

To rely on the people who caused the problem to repair the problem is in itself the definition of insanity.

The next large Tea Party March in D. C. will be armed.  The  Constitution will be restored.  It is the only option left.

You are probably right, Ralph.   We cannot lie down and give up this great nation that we love so much to the  usurpers.   Whatever is needed must be done.

     

Ralph:  There is a Million Man March scheduled on September 15 thu 17.  Though not completely through the organization of the "Tea Party"  it's hoped to lift the spirits and raise number of voter turn out.  I only know this through another blog last week here on TPN.  Karen Ruff and a Dawn somebody listed it.

Your Quantum links are current working hypotheses, perhaps  theories. Don't know how they tie to "Social Justice" though! 

Civil law suits against doctors punish bad doctors. Not always true, There was only one perfect man on earth and everyone makes a mistake sooner or later. When the mistake is re-accuring then you have bad medical practice. I respect you Judson and I understand your defense for a Lawyers income but I believe Law suits have become so outragious that Doctors have to have enormous liability insurance. If they had nothing, you couldn't get a Lawyer to take the case. You see Lawyers advertising on tv and I compare this to advertising foodstamps and welfare, they are creating a mindset that everything needs to be settled by a lawsuit and the only winners are the Lawyers. For once I'd like to hear you give good solutions to the high cost of healthcare and not try to protect the slush fund for Lawyers. Don't think that I favor Doctors either, the first thing they ask you is what's wrong with you and that's what I came to them to find out. I hope this is taken as it is intended and I'm just disagreeing with you not trying to bash you in any way. Thanks for all you do.

@ Lou in Alabama  ~  I agree with you 100 % !  The only "Tort Reform" we NEED is "LOSER  PAYS" !!!  That will put a stop to ALL the 'ambulance chaser' law firms and probably a lot of the Liberal /  Greenies  BULLSH*T  lawsuits against "We the People' and capitalism.

  "LOSER PAYS" would stop a LOT of the abuses of our legal system. That's 'FAIR'   tort reform !!!

have no problem at all against law suits; just about the frivolous ones; the ones insurance companies pay to make go away 'cause the defense is more costly than paying out a few thousand to the ambulance chasers........it costs around 100.000$ to defend against a frivolous one; one w/o any merit that is why the trolling lawyers file, then offer to settle for about 1/2 of that! from a business point of view it makes more sense to settle BUT not from a moral point of view; it is giving in to extortion; plain and simple!; why do you think one of the reasons jobs are fleeing overseas?; taxes and tort..if I am correct; the profession of trial attorney does not even exist in the Peoples Republic of China.........                                               Lou
