MSU is a very specific scientific and legal term. Never heard of it? It is a concept you need to be very much aware of because the consequences of MSU could end up hitting very close to home.
What is MSU?
Well it is not Mississippi State University!
In Washington we are seeing MSU on full display. The Congress is finally realizing the sequestration law that they agreed to last year is a disaster. The disastrous part of that bill is the massive cuts in defense spending. Even the extremely liberal Defense Secretary Leon Panetta is calling those cuts catastrophic.
So enter the Republicans, specifically Lindsay Graham and John McCain. They want to punt the sequestration for a year but come up with some “spending cuts.”
One of the “spending cuts” they want to come up with is to resurrect a Senate Bill on Federal Tort Reform. This bill would not only put caps on damages but would also set a wage scale for attorneys. According to the Congressional Budget Office, this would save billions.
Houston we have a lot of problems and a lot of MSU here.
First, let’s ignore the constitutional issues of Federal Tort Reform for a moment. After the Obamacare Tax decision, I question whether or not Chief Justice Roberts and his liberal friends on the Supreme Court know the Constitution. However, anyone else with half a brain would see this would be declared unconstitutional.
No matter how you feel about Federal Tort Reform and lawyers, you should be standing to oppose this lunatic idea.
Why?
Because the Congressional Budget Office is never right when it says how much something will cost or how much it will save. A baseball player who is blind in one eye and can’t see out of the other has a greater chance of hitting a ball than the CBO has of getting anything right.
The CBO are experts at MSU.
Just in case you haven’t caught on yet, MSU stands for “Making stuff up!”
This is the problem and this is why everyone should be telling the Senate and the House not to throw Federal Tort Reform into any proposed modification of the sequestration law!
In the first 9 months of this fiscal year, we have run a $900 billion dollar deficit. Obama is working very hard to destroy the economy and the American dollar.
We need real budget cuts.
Eighteen months ago, I first railed about a GAO report that identified hundreds of billions of dollars in waste, fraud and duplicated services within the government.
What has been done to eliminate that since then?
Nothing.
We have programs that exist only to help get politicians reelected. Is anything done about those? No.
You can agree with me or disagree with me on Federal Tort Reform. You can like lawyers or think every lawyer in this nation should be exported to Mongolia. Any sane American should realize our spending is out of control and these phantom spending cuts that people like John McCain want to make are nothing more than an exercise in MSU.
If you want to debate Federal Tort Reform, fine we can have that debate. Unless you totally reject the 10th Amendment and the concept of Federalism, you will agree that this is unconstitutional.
What everyone can agree on is using it as a smokescreen to claim non-existent budget cuts is simply lying to the American people.
John McCain’s track record for being right is about like that of the Congressional Budget Office.
Why should we listen to either of them when all they do is MSU?

1. Go down the list from the report you listed above and start implementing it.
2. Quit giving illegal aliens tax refunds for money that they never paid in, among other things.
3. Start means testing and drug testing people receiving SSI and welfare benefits. I know a person who has been on SSI for several years due to bipolar disorder. This person refuses to take their meds because they'd rather drink and smoke pot all day long. Yep, I reported them - nothing was done and they are still on SSI. In another case, my husband sells vintage tennis shoes on eBay as a hobby. A person that won one of his auctions emailed him after the auction was over ($330 was the winning bid) and told him he couldn't send the money until he got his SSI check. Our tax dollars at work.
On a related note, what do you suggest be done to curtail frivolous lawsuits, Judson? I know you are an attorney, and if anyone can come up with some good ideas, it would be you. Here's a local example of one -- a teacher who was denied tenure and dismissed filed a huge lawsuit saying she was dismissed because she attended Barack Obama's inauguration. She'd been caught red-handed misappropriating class field trip funds, and she said that she was punished because she wasn't white. They decided to settle with her rather than go through the time and expense of a taking the suit to trial. Stupid stuff like this has got to stop.

I would arrest them all; no matter the cost and even if we had to use National Guard, Military, etc.DEPORT THEM ALL. Budget balanced in no time... No more over-crowded prisons, No more schools overcrowded... No more problem with our bulging medical costs - Hospitals and Emergency Services restored... Junk cars with unlicensed drivers - gone ... etc. etc. etc.

My understanding is, In order to sue the government, they have to deem it can even happen . . . . . consequently few, if any, lawsuits, for damages, are brought against the Federal government . . . . so why do they talk about Tort Reform.
Tort Reform is a State issue as in Texas and other States have elected to do. States are laboratories for testing ideas.
If your State decides to set Tort Reform limits and you don't like it, vote with your feet.

It's good at wars and freeways and dams and parks but lousy with personal issues like health care and abortion, education , things that are very individual should be handled at the local level. Like any organization it wants to get bigger. It feels it can do so much more if it just had more money and more power.
The trouble is they get that money and power from We The People. A simple glance at the USDEBTCLOCK.ORG and anybody can see we've receieved, shall we say, a very poor return on investment.
Take the emotion out of it and the bottom line is they are irresponsible with our money and our freedom. It's time to take it back.

Permalink Reply by Rich Knoch on Actually the Federal Government is a disaster (for the past few decades) at managing Freeways, Dams and Parks as they incinerate money they don't need to spend . . . . from a budget that doesn't exist and a good portion of it is wasted on simple stupid initiatives, poor planning and execution of those late plans.
One of the many problems we have is the inordinate, ill-conceived and draconian land ownership and control by the Federal Government. They have locked up our resources (energy, minerals and private development) from Taxpayers and are pretty poor stewards of OUR PROPERTY.
The USA could eliminate a large portion of the National Debt if they would sell or open for resource development, portions of the lands they mismanage at Taxpayers and Ranchers expense.
The reason they won't divest some of this property is that hundreds of thousands of useless bureaucrats have their vested interests in perpetuating this glaring national disaster.
We are good at war . . . . if the pecker-heads in Washington would just let us win, end it, come home and announce an international warning, that anyone who messes with America will find themselves in a land of glass.
